Preparing for the Real Estate Report

Quick Summary of FinCEN's RRE Residential Real Estate Reporting Rule

Get ready for FinCEN’s new RRE (Residential Real Estate) Reporting requirements starting 3/1/2026 for cash residential closings. 

 

Starting March 2026, settlement agents must report ALL residential real estate transactions where:

• The buyer is an LLC, corporation, trust, or other legal entity (not an individual)

• The purchase is made without a traditional bank loan (such as using cash, crypto, seller financing, private loans, etc.)

• The property is 1-4 family residential real estate anywhere in the U.S.

• No exemption applies. Exemptions are listed here.

Note: There is now price minimum. Even $1 sales must be reported if they do not have an exemption.

The RER form can include up to 111 fields as specified by FinCEN (31 CFR §1031.320, April 2024), with typically about 60% of these fields needed for standard transactions. The total number of required fields varies based on the complexity and specific details of each transaction. This report is dynamic and different fields are required depending on transaction details such as party type.

Some details include, but are not limited to, the following:

 

  1. Buyer (Transferee):

    • If an individual: Full legal name, residential address, identification number (SSN or foreign ID), date of birth, citizenship.

    • If an entity: Entity’s full legal name, address of principal business, EIN or foreign tax ID. Beneficial owners’ details (individuals with substantial control or owning 25% or more of the entity) including full names, dates of birth, addresses, citizenship, and identification numbers (SSN or foreign IDs). Signer details are also required.

    • If a trust: Trust’s full legal name, date trust executed, IRS TIN or foreign tax ID, revocable status, and detailed beneficial owner information (trustees, beneficiaries with significant rights, grantors, or settlors with revocation rights). Trustee details include full name, address, citizenship, and identification numbers.

  2. Seller (Transferor):

    • If an individual: Full legal name, date of birth, residential address post-settlement, and identification number (SSN or foreign ID).

    • If an entity: Full legal name, trade name (if applicable), principal business address, EIN or foreign tax ID.

    • If a trust: Trust’s full legal name, date of trust execution, IRS TIN or foreign jurisdiction tax ID, and detailed trustee information including names, addresses, citizenship, and identification numbers.

  3. Person Providing Payment (if different from the buyer):

    • Name

    • Payment amount

    • Payment method (wire transfer, check, etc.)

    • Bank details (bank name, account numbers)

 

The FincenRealEstateReport.com portal simplifies this process by automatically exporting completed RER forms, similar to how current GTO CTR forms are managed.

 

 

Real Estate Reports (RER) must be filed electronically with FinCEN using the official PDF form starting December 1, 2025. The reporting process involves clearly communicating the filing requirements to all parties, collecting detailed buyer, seller, and payment information, securely storing this data for five years, and filling out the PDF form. Completing these forms typically takes 2 to 6.5 hours, depending on transaction complexity. You can reduce this time to 10 minutes with software or offload it completed with a managed service.

 

The filing deadline is the last day of the month following the month when the closing occurred, or 30 calendar days after closing, whichever is later. In practice, this gives reporting persons approximately 30 to 60 days to file each report.

 

We recommend having transaction parties sign a Transaction Form that has them attest to the accuracy of the information, protects settlement agent liability and authorizes passing compliance costs to settlement statements.

 

You can limit your liability related to FinCEN Real Estate Report filings and recover compliance costs through the following methods:

 

 

1. Use a Certification Form:
Require buyers and sellers to complete and sign a certification form clearly stating they are responsible for providing accurate information. This establishes reasonable reliance criteria, as it documents that your firm relied on information explicitly certified by transaction parties. This form can also authorize passing through FinCEN compliance costs to settlement statements.

Recommended form: Real Estate Report Certification Form (modify template as needed)

 

 

2. Clearly Document Reasonable Reliance:
Under FinCEN guidelines, you can demonstrate reasonable reliance by:

  • Obtaining a written certification from transaction parties verifying the accuracy of provided details.

  • Ensuring the certification explicitly holds the signatories accountable for false or misleading information.

  • Retaining these signed certifications securely for at least five years as evidence of your firm’s diligence.

 

3. Use Software or a Managed Filing Service:
Utilize specialized software or a managed filing service to streamline compliance. These solutions collect information securely, offer quick digital attestations of liability and accuracy, track deadlines for any number of filings, and manage record-keeping requirements.
