How it Works

Easy FinCEN Filings for Trustee Sales

FinCEN’s Residential Real Estate Reporting Rule enforcement begins March 1, 2026. If you are the person recording or preparing the deed in a foreclosure auction, FinCEN will likely treat you as the reporting person responsible for filing the Real Estate Report. That responsibility includes collecting required information on all parties, identifying and reporting beneficial owners of any entity buyers, obtaining signed buyer certifications, and submitting the report within 30 days after the sale. This service is designed to take that entire burden off your shoulders.

FAQ

When does reporting start?

March 1, 2026. Reports must be filed by the final day of the calendar month following the transfer of the property.

Who is responsible for filing in a foreclosure sale?

FinCEN assigns responsibility using a reporting cascade. In foreclosure sales without a traditional closing or escrow agent, the responsibility typically falls to the person who prepares or records the deed. In practice, this is often the foreclosure trustee or foreclosure attorney.

How long does setup take?

Most firms are live in under 30 minutes. No software installation is required.

What happens if I do nothing?

Failure to file can result in significant civil penalties and, in cases of willful non-compliance, criminal exposure. This service is designed to eliminate that risk.

Does this apply to non-judicial foreclosure sales?

Yes. Non-judicial foreclosure and trustee sales are not automatically exempt. If the sale is a cash transaction and the buyer is an entity or trust, a Real Estate Report is generally required unless a specific exemption applies.

Can the cost be passed to the buyer?

In many states, yes. Where pass-through is not allowed, the buyer can pay the filing fee directly. Either way, you do not need to absorb the cost.

What transactions require a report?

Non-financed residential property transfers where at least one buyer is a legal entity or trust, unless a specific exemption applies.

How much time does this take for me and how do I know when it's done?

About one minute per transaction. Everything else is handled for you. You receive status updates and dashboard visibility confirming when all required information has been collected and the report is ready for filing.
